By accessing or using Schema (the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not use the Service.
These Terms constitute a legally binding agreement between you and Schema. Please read them carefully.
2. Service Description
Schema is a property development analysis platform that provides:
- Interactive mapping and property selection tools (Atlas)
- Building envelope and development yield calculations (Generator)
- Financial feasibility modelling (Cashflow)
The Service uses publicly available data from NSW government sources and user-provided inputs to generate analysis and projections.
3. Beta Service Disclaimer
Important: Schema is currently provided as a free beta service. The Service is provided "as is" without warranties of any kind. Features, data, and availability may change without notice.
During the beta period:
- The Service may contain bugs, errors, or inaccuracies
- Features may be added, modified, or removed without notice
- Data may be reset or lost during updates
- Service availability is not guaranteed
- Free tier limitations apply (e.g., 3 saved options, 1 project)
4. User Accounts
4.1 Registration
To use certain features, you must register for an account. You agree to:
- Provide accurate and complete registration information
- Maintain the security of your password
- Notify us immediately of any unauthorised access
- Be responsible for all activities under your account
4.2 Account Tiers
The Service may offer different account tiers with varying features and limitations. Current limitations for the free tier include:
- Maximum 3 saved development options
- Maximum 1 active project
- Maximum 5 PDF exports per month
5. Acceptable Use
You agree not to:
- Use the Service for any unlawful purpose
- Attempt to gain unauthorised access to the Service or its systems
- Interfere with or disrupt the Service or servers
- Scrape, data mine, or bulk download data from the Service
- Use the Service to compete with or replicate our offerings
- Misrepresent your identity or affiliation
- Violate any applicable laws or regulations
6. Intellectual Property
6.1 Our Content
The Service, including its design, features, and content, is owned by Schema and protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or create derivative works without our written permission.
6.2 Your Content
You retain ownership of any data, projects, or content you create using the Service. By using the Service, you grant us a limited licence to store, process, and display your content solely to provide the Service to you.
6.3 Third-Party Data
The Service incorporates data from NSW government sources, which is subject to the applicable government data licences. You agree to comply with any such licence terms.
7. Disclaimers and Limitations
Not Professional Advice: The Service provides general information and analysis tools only. It does not constitute professional advice in planning, architecture, engineering, legal, financial, or any other field. Always consult qualified professionals for specific projects.
7.1 No Warranties
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:
- Merchantability or fitness for a particular purpose
- Accuracy, completeness, or reliability of any data or calculations
- Uninterrupted or error-free operation
- Compliance with any specific planning or building requirements
7.2 Data Accuracy
Planning controls, zoning data, and other information displayed in the Service are derived from third-party sources and may be:
- Outdated or not reflect recent amendments
- Incomplete or contain errors
- Subject to interpretation by relevant authorities
You must independently verify all information with the relevant council or authority before making any decisions.
7.3 Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, SCHEMA AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR:
- Any indirect, incidental, special, consequential, or punitive damages
- Any loss of profits, revenue, data, or business opportunities
- Any damages arising from reliance on the Service or its outputs
- Any damages exceeding the amount paid by you for the Service (if any)
Some jurisdictions do not allow the exclusion of certain warranties or limitations of liability, so some of the above limitations may not apply to you.
7.4 Australian Consumer Law
Nothing in these Terms excludes, restricts, or modifies any consumer guarantee, right, or remedy conferred on you by the Australian Consumer Law (Schedule 2 of the Competition and Consumer Act 2010 (Cth)) that cannot be excluded, restricted, or modified by agreement.
8. Indemnification
You agree to indemnify, defend, and hold harmless Schema and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, costs, and expenses (including legal fees) arising from:
- Your use of the Service
- Your violation of these Terms
- Your violation of any third-party rights
- Any content you submit through the Service
9. Termination
9.1 By You
You may terminate your account at any time by contacting us or using account settings. Upon termination, your right to use the Service will immediately cease.
9.2 By Us
We may suspend or terminate your account at any time, with or without cause, with or without notice. Reasons for termination may include:
- Violation of these Terms
- Fraudulent or illegal activity
- Extended periods of inactivity
- Discontinuation of the Service
9.3 Effect of Termination
Upon termination, your data may be deleted. We recommend exporting any data you wish to retain before terminating your account.
10. Governing Law
These Terms are governed by the laws of New South Wales, Australia. Any disputes arising from these Terms or your use of the Service shall be subject to the exclusive jurisdiction of the courts of New South Wales.
11. Changes to Terms
We may modify these Terms at any time. We will notify you of material changes by posting a notice on the Service or sending you an email. Your continued use of the Service after such modifications constitutes acceptance of the modified Terms.
